1. About these terms

These terms apply to the web design and care plan services provided by Tolka Studio, operated by Peter Kelly, Dunboyne, Co. Meath, Ireland (peter.kelly@tolkastudio.ie). By engaging our services you agree to these terms.

2. Project engagement

All projects begin with a written proposal and signed agreement. Work begins on receipt of the deposit (50% of the project fee). The remaining 50% is due on launch.

If a project is cancelled after work has commenced, the deposit is non-refundable. Any work completed beyond the deposit value will be invoiced at a pro-rata rate.

3. Client responsibilities

You agree to provide content (text, images, logo files) in a timely manner. Delays caused by late content may affect the agreed timeline. Tolka Studio is not responsible for delays outside its control.

4. Revisions

Each project includes two rounds of revisions. Additional revisions beyond this are charged at an agreed hourly rate. Revision rounds are for refinements, not scope changes. Significant changes to the original brief will be treated as new scope and quoted separately.

5. Care plan

Monthly care plan fees are billed in advance. Plans can be cancelled with 30 days' written notice. On cancellation, hosting and support services end at the close of the paid period. You retain full ownership of your website files and content.

6. Intellectual property

On receipt of final payment, full ownership of the completed website design and code passes to you. Tolka Studio retains the right to display the completed work in its portfolio unless you request otherwise in writing.

Any stock images, fonts, or third-party tools used in the project are subject to their own licences, which we will communicate to you clearly.

7. Liability

Tolka Studio is not liable for any loss of business, revenue, or data arising from use of your website. Our total liability in any matter is limited to the fees paid for the relevant project or service.

We make reasonable efforts to ensure websites are error-free at launch, but we cannot guarantee compatibility with all devices, browsers, or future software updates.

8. Governing law

These terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.
